These Terms & Conditions govern all bookings, studio hire, photography sessions, content creation, events and related services provided by AÇAÍ Studios ("AÇAÍ Studios", "we", "our" or "us").
By making a booking, accessing the AÇAÍ Studios website, entering the premises or otherwise using our facilities or services, you ("the Booking Holder", "client", "you" or "your") agree to be bound by these Terms & Conditions.
All bookings require full payment at the time of booking unless otherwise agreed in writing by AÇAÍ Studios. Payment of a booking, together with use of the premises or services, constitutes acceptance of these Terms & Conditions by the Booking Holder and all attendees forming part of that booking.
If you do not agree to these Terms & Conditions, you must not use the AÇAÍ Studios website, enter the premises or make a booking.
1. Studio Use & Care
AÇAÍ Studios is a professional creative environment designed for photography, videography, content creation, workshops and private hire. All clients and attendees are expected to use the premises respectfully, responsibly and in accordance with these Terms & Conditions.
The Booking Holder is responsible for ensuring that all attendees comply with the following requirements:
All furniture, fixtures, props, equipment, walls, floors, windows, doors and decorative finishes must be handled with reasonable care and used only for their intended purpose.
Furniture and large props must be lifted when moved and must not be dragged across the floor. All items must be returned to their original positions before the end of the booking unless otherwise agreed.
Standing, climbing or jumping on furniture, countertops, props or studio structures is strictly prohibited.
The studio must be left in a clean, tidy and orderly condition. All rubbish must be placed in the designated bins and all personal belongings removed before departure.
Hot food, open drinks and liquids are not permitted on studio sets, furniture or backdrops unless prior written approval has been obtained from AÇAÍ Studios.
Makeup, fake tan, body oils, paint, glitter, powders, sand, mud, wax, adhesives, tape or any other substance likely to stain, damage or permanently mark the premises must not be used on or near studio furniture, walls, backdrops or fixtures without prior written approval.
No nails, screws, fixings, adhesives or other materials may be attached to walls, ceilings, furniture or fixtures without prior written consent from AÇAÍ Studios.
Any accident, damage, spill, breakage, equipment fault or safety concern occurring during the booking must be reported to AÇAÍ Studios immediately.
The Booking Holder is responsible for ensuring that all doors are secured before leaving the premises. The studio key must be returned to the designated key safe immediately following the booking, and the key safe code must be scrambled before departure.
Studio access codes, keys and security information are confidential and must not be shared with unauthorised persons or copied without written permission.
Lost, stolen, damaged or unreturned keys or access devices will incur the applicable replacement and security charges set out within these Terms & Conditions.
Failure to comply with this section may result in additional cleaning or damage charges, the immediate termination of the booking without refund, the refusal of future bookings, and any other remedies available to AÇAÍ Studios under these Terms & Conditions.
2. Bookings & Responsibility
All bookings must be made in advance and are only deemed confirmed once full payment has been successfully received and written booking confirmation has been issued by AÇAÍ Studios.
The individual or organisation making the booking ("the Booking Holder") enters into this agreement on behalf of all attendees and accepts responsibility for ensuring that every person attending the booking complies with these Terms & Conditions.
The Booking Holder remains responsible for the conduct, actions and any loss, damage or breaches of these Terms & Conditions caused by themselves or any attendee, contractor, supplier, model, performer, employee, guest or other individual attending under their booking.
It is the responsibility of the Booking Holder to ensure that the booking details, including the date, time, duration and any additional services, are accurate at the time of booking. Any errors or discrepancies must be reported to AÇAÍ Studios as soon as reasonably practicable.
Bookings may not be transferred, assigned or sublet to another individual or organisation without the prior written consent of AÇAÍ Studios.
AÇAÍ Studios reserves the right to make reasonable changes to the studio layout, furniture, props, equipment, facilities, operating procedures or house rules where necessary for health and safety, maintenance, operational requirements or to improve the customer experience. Such changes shall not constitute a breach of this agreement.
Where AÇAÍ Studios reasonably believes that a proposed booking or activity is unsuitable, unsafe, unlawful or inconsistent with the intended use of the premises, it reserves the right to refuse or cancel the booking in accordance with these Terms & Conditions.
3. Payment, Cancellations & Changes
Payment
All bookings must be paid in full at the time of booking unless otherwise agreed in writing by AÇAÍ Studios.
No booking shall be confirmed, reserved or guaranteed until full payment has been successfully received.
Cancellations
Cancellation requests must be submitted in writing by email.
The following cancellation policy applies:
More than 7 days before the booking date: Refund of all sums paid.
Within 7 days of the booking date: 25% of the total booking fee will be retained, with the remaining balance refunded.
Within 72 hours of the booking start time: No refund will be issued.
Any refunds due will be processed using the original payment method within a reasonable period.
Rescheduling
Instead of cancelling, clients may request to reschedule their booking.
Rescheduling requests:
Must be made more than 72 hours before the booking start time.
Must be for a new booking date within 14 days of the original booking, unless otherwise agreed by AÇAÍ Studios.
Are subject to studio availability and are not guaranteed.
Where a reschedule request is accepted, no cancellation fee will apply.
Only one complimentary reschedule will normally be permitted per booking unless otherwise agreed in writing.
No-Shows
Failure to attend a confirmed booking without prior notice shall be treated as a no-show.
No-shows are non-refundable and the full booking fee will remain payable.
Studio-Initiated Cancellations
If AÇAÍ Studios is unable to fulfil a booking due to unforeseen circumstances beyond its reasonable control, clients will be offered either:
A full refund of all sums paid; or
The opportunity to reschedule the booking to a mutually agreed date at no additional charge.
Except where required by law, AÇAÍ Studios shall not be liable for any indirect or consequential losses, including but not limited to travel costs, accommodation, loss of earnings, production costs or other expenses incurred as a result of a cancelled booking.
Force Majeure
AÇAÍ Studios shall not be liable for any delay, interruption or failure to perform its obligations where such failure arises from events beyond its reasonable control, including but not limited to severe weather, fire, flood, power failure, internet or utility outages, government restrictions, industrial disputes, acts of terrorism, public health emergencies or any other unforeseen event making the booking impracticable or unsafe.
Where reasonably possible, AÇAÍ Studios will work with the client to reschedule the booking or provide an appropriate refund in accordance with these Terms & Conditions.
4. Session Timing, Late Arrivals & Overtime
Studio access is strictly limited to the dates and times confirmed within your booking.
The booked session includes all activities associated with your hire, including arrival, unloading, setup, styling, photography, filming, content creation, breaks, packing away, cleaning, re-setting furniture, loading and departure. Clients must vacate the premises by the end of their booked session.
Late arrival does not extend the booking period or reduce any applicable hire charges.
Should additional time be required, the booking holder must contact AÇAÍ Studios as soon as possible. Any extension is subject to availability and cannot be guaranteed.
Where additional time is approved, it will be charged at the applicable hourly rate and must be paid immediately or in accordance with the booking agreement.
If the booking overruns without prior approval, AÇAÍ Studios reserves the right to charge for the additional time occupied, together with any reasonable costs or losses arising where the overrun delays, disrupts or prevents subsequent bookings.
Where a client remains on the premises beyond their allocated booking time without authorisation, AÇAÍ Studios reserves the right to take any reasonable action necessary to regain possession of the premises and recover any resulting costs or losses, where permitted by law.
5. Damage, Cleaning & Additional Charges
The booking holder accepts full responsibility for any loss, damage, excessive cleaning or reinstatement costs arising during their booking, including any damage or loss caused by attendees, contractors, suppliers, models, performers, guests or any other person attending under their booking.
Where damage, excessive cleaning, missing items or breaches of these Terms & Conditions are identified following a booking, and AÇAÍ Studios reasonably believes that they occurred during that hire period based on the available evidence, AÇAÍ Studios reserves the right to recover the reasonable costs of repair, replacement, reinstatement, specialist cleaning, administration and any directly associated losses, where permitted by law.
This includes, but is not limited to:
Broken, stolen, marked, stained or damaged furniture, fixtures, props, equipment, walls, floors, windows, doors or decorative finishes.
Damage caused by negligence, misuse or inappropriate handling of studio furniture, equipment or facilities.
Damage caused by adhesives, tape, nails, screws, fixings or other materials attached to walls, ceilings, furniture or fixtures without prior approval.
Damage caused by makeup, fake tan, body oils, paint, glitter, powders, sand, liquids, food, drinks or other staining substances.
Damage resulting from smoking, vaping, naked flames, prohibited items or activities presenting a fire risk.
Failure to return the studio, furniture or equipment to its original condition at the end of the booking.
Loss of studio keys, access devices or any property belonging to AÇAÍ Studios.
Cleaning Charges
Where the studio is not left in a clean and satisfactory condition, the following charges may apply:
Standard additional cleaning (light mess, rubbish left, furniture not reset): £50
Heavy cleaning (spillages, staining, excessive rubbish, makeup, fake tan, paint, glitter or similar residue): £100–£200
Specialist or professional cleaning: Charged at cost plus a £50 administration fee
Damage Charges
Where repair or replacement is required, the following charges may apply:
Minor damage (surface marks, scuffs or minor repairs): From £50
Moderate damage (damaged furniture, broken props, staining or repairable items): £100–£500
Major damage (irreparable furniture, structural damage, building fabric or equipment requiring replacement): Full repair or replacement cost
Where replacement is necessary, AÇAÍ Studios reserves the right to recover the reasonable cost of supplying, delivering, installing or reinstating the damaged item.
Lost, stolen or unreturned items belonging to AÇAÍ Studios will be charged at their full replacement value.
Lost or unreturned studio keys will incur a £75 charge to cover replacement, security and administrative costs.
Additional Losses
Where damage or breaches of these Terms & Conditions result in future bookings being cancelled, delayed or relocated, or otherwise cause AÇAÍ Studios to suffer a direct financial loss, AÇAÍ Studios reserves the right to recover such reasonable losses where permitted by law.
Payment of Additional Charges
AÇAÍ Studios reserves the right to charge the payment method used to secure the booking, or any damage deposit or pre-authorisation held, for any reasonable cleaning charges, repair costs or other sums due under these Terms & Conditions.
Where charges are invoiced separately, payment must be made within 7 days of the invoice date.
Reasonable supporting evidence, including photographs, quotations, invoices or repair reports, will be made available upon request where appropriate.
Failure to pay outstanding sums may result in recovery action, additional reasonable costs where recoverable, and the refusal of future bookings.
6. Conduct, Safety & Restrictions
The booking holder is responsible for the conduct and behaviour of all attendees throughout the duration of the booking.
Clients and their guests must:
Behave in a respectful and responsible manner at all times.
Follow all instructions provided by AÇAÍ Studios relating to the safe use of the premises.
Keep noise levels to a reasonable level to avoid disruption to neighbouring businesses and residents.
Ensure alcohol is not consumed on the premises unless prior written approval has been granted by AÇAÍ Studios.
Refrain from using illegal substances or engaging in any unlawful or anti-social behaviour.
Dogs & Other Animals
Dogs and other animals are permitted within AÇAÍ Studios only with the prior written approval of AÇAÍ Studios, and subject to the following conditions:
All animals must be kept under the full control of their owner or handler at all times and must not be left unattended within the studio.
Animals must not be permitted on furniture, props, backdrops or set pieces unless expressly agreed in advance as part of the booking (e.g. pet photography shoots).
The booking holder is responsible for cleaning up after any animal, including fur, mess, mud, hair or waste, and for any resulting cleaning or damage charges in accordance with Section 5 of these Terms & Conditions.
The booking holder is fully responsible for any injury, damage, disturbance or allergic reaction caused by an animal brought onto the premises, except where such liability cannot legally be excluded.
AÇAÍ Studios reserves the right to refuse entry to, or request the immediate removal of, any animal that it reasonably considers to be a health and safety risk, a nuisance, aggressive, or otherwise unsuitable for the studio environment.
Approval for an animal to attend a booking does not extend to future bookings and must be requested and confirmed in writing on each occasion.
AÇAÍ Studios reserves the right to immediately terminate any booking, require individuals to leave the premises, or refuse future bookings where behaviour is deemed unsafe, abusive, threatening, disruptive, unlawful, or otherwise in breach of these Terms & Conditions. In such circumstances, no refund will be provided.
For private events, celebrations, bridal showers, baby showers, parties, workshops or similar gatherings, the booking holder remains fully responsible for the conduct of all guests and for any damage, staining, spillages, excessive cleaning or other losses arising from the booking.
7. FIRE SAFETY & PROHIBITED ACTIVITIES
The safety of our clients, neighbouring businesses and the premises is of paramount importance.
The following are strictly prohibited anywhere within AÇAÍ Studios unless expressly authorised in writing by AÇAÍ Studios:
Smoking of any kind.
Vaping or the use of electronic cigarettes.
Candles, incense or any naked flames.
Sparklers, fireworks, pyrotechnics or fire effects.
Smoke machines, haze machines or fog machines.
Gas appliances, portable BBQs or any heat-producing equipment not supplied or approved by AÇAÍ Studios.
Any activity that creates an unnecessary fire risk or has the potential to activate the building's fire alarm system.
Any evidence of smoking, vaping, burn damage, fire-related damage or unauthorised use of prohibited items may result in the immediate termination of the booking without refund. The booking holder will be responsible for the reasonable costs of any repairs, specialist cleaning, damage to studio property, or other losses arising directly from such activities, where permitted by law.
All attendees must comply with the studio's fire safety procedures and must not interfere with any fire alarms, fire extinguishers, emergency lighting, fire exits or other fire safety equipment.
8. FIRST AID & MEDICAL RESPONSIBILITY
A basic first aid kit is available on the premises for the treatment of minor injuries only. It is provided as a courtesy and does not replace professional medical care or emergency treatment.
AÇAÍ Studios does not guarantee that a qualified first aider or medically trained person will be present during any booking.
Clients are responsible for:
Managing their own health and medical conditions.
Bringing and administering any personal medication they may require, including (but not limited to) inhalers, EpiPens, insulin or prescribed medication.
Ensuring members of their own party are aware of any relevant medical conditions or emergency procedures.
In the event of a serious illness, injury or medical emergency, AÇAÍ Studios or its representatives may contact the emergency services where considered necessary. Any medical treatment, ambulance transport or associated healthcare costs remain the responsibility of the individual concerned.
By using the premises, the booking holder acknowledges that:
First aid facilities provided by AÇAÍ Studios are limited to basic assistance for minor injuries.
They are responsible for the health, safety and wellbeing of themselves and all attendees during the booking.
AÇAÍ Studios accepts no responsibility for medical conditions, illnesses or injuries arising during the booking except where caused by the negligence of AÇAÍ Studios or where liability cannot legally be excluded.
9. Personal Property, Liability & Parking
All personal belongings, photographic equipment, filming equipment, lighting, laptops, mobile devices, clothing, props, merchandise and any other items brought onto the premises remain the sole responsibility of the booking holder and their attendees.
AÇAÍ Studios accepts no responsibility for the loss, theft or damage of any personal property, equipment or vehicles whilst on the premises, except where such loss or damage is caused by the negligence of AÇAÍ Studios or where liability cannot legally be excluded.
Clients are responsible for ensuring that all equipment brought into the studio is safe, fit for purpose and used in accordance with the manufacturer's instructions. Any damage caused to the studio, its fixtures, furnishings or equipment through the use of client-owned equipment remains the responsibility of the booking holder.
Parking, where available, is provided for convenience only and is used entirely at the vehicle owner's risk. AÇAÍ Studios accepts no responsibility for loss, theft or damage to vehicles or their contents whilst parked on or near the premises.
Nothing within these Terms & Conditions shall exclude or limit the liability of AÇAÍ Studios for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited under applicable law.
10. General Legal Terms
These Terms & Conditions apply to the booking holder and every individual attending or participating in the booking. The booking holder is responsible for ensuring that all attendees comply with these Terms.
No amendment, variation or waiver of these Terms & Conditions shall be valid unless confirmed in writing by AÇAÍ Studios.
AÇAÍ Studios reserves the right to correct any typographical, administrative or pricing errors, omissions or inaccuracies within its documentation, website or booking system without incurring liability.
If any provision of these Terms & Conditions is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
Any failure or delay by AÇAÍ Studios to enforce any provision of these Terms & Conditions shall not constitute a waiver of its right to enforce that provision or any other provision at a later date.
These Terms & Conditions, together with any booking confirmation or written agreement issued by AÇAÍ Studios, constitute the entire agreement between the parties and supersede any previous discussions, representations or understandings relating to the booking.
These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Liability & Insurance
The booking holder is responsible for ensuring that the studio is suitable for their intended use and that all attendees conduct themselves safely whilst on the premises.
The booking holder accepts full responsibility for the actions, conduct and safety of all attendees, contractors, suppliers, models, performers, employees, guests and any other individuals attending under their booking.
Clients are responsible for ensuring that all equipment, props, staging, decorations, electrical equipment and any other items brought onto the premises are safe, fit for purpose and used in accordance with all applicable health and safety requirements.
AÇAÍ Studios accepts no responsibility for injury, loss, damage, theft or expense arising from the acts or omissions of the booking holder or their attendees, or from the misuse of the premises, facilities or equipment, except where such liability cannot legally be excluded.
Where a booking involves commercial productions, workshops, events, large group bookings, external suppliers or activities presenting an increased level of risk, AÇAÍ Studios may require the booking holder to hold valid Public Liability Insurance and, where applicable, Employer's Liability Insurance.
Proof of insurance must be provided upon request prior to the booking. Failure to provide satisfactory evidence of the required insurance may result in the booking being refused or cancelled without liability to AÇAÍ Studios.
Indemnity
The booking holder agrees to indemnify and keep indemnified AÇAÍ Studios, its owners, employees and representatives against all reasonable claims, liabilities, losses, damages, costs, expenses and legal fees arising directly from:
Any breach of these Terms & Conditions by the booking holder or any attendee.
Any negligent, reckless or unlawful act or omission of the booking holder or their attendees.
Any damage to the studio, its fixtures, furnishings, equipment or neighbouring property caused during the booking.
Any claim brought by a third party arising directly from the booking holder's use of the premises or the actions of their attendees.
This indemnity shall not apply to the extent that any claim, loss or liability arises directly from the negligence or breach of duty by AÇAÍ Studios.
Nothing within these Terms & Conditions excludes or limits the liability of AÇAÍ Studios for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited under applicable law.
12. Disputes, Inspection & Costs
AÇAÍ Studios reserves the right to inspect the premises at any reasonable time following a booking to assess the condition of the studio, its fixtures, furnishings, equipment and facilities.
Where damage, excessive cleaning requirements, missing items or breaches of these Terms & Conditions are identified, AÇAÍ Studios may investigate the circumstances and determine the reasonable costs of repair, replacement, cleaning or reinstatement.
Where appropriate, AÇAÍ Studios may rely upon photographs, video recordings, maintenance reports, booking records, witness statements, invoices, contractor reports or any other relevant evidence when assessing responsibility for damage or loss.
The booking holder agrees to cooperate with any reasonable investigation relating to damage, loss, safety incidents or breaches of these Terms & Conditions.
Where AÇAÍ Studios reasonably believes that damage or loss occurred during a booking, the booking holder may be held responsible for the reasonable costs of repair, replacement, cleaning, reinstatement and any directly associated administrative costs, where permitted by law.
Invoices relating to damage, cleaning or other additional charges shall be issued within a reasonable period following the completion of any investigation and must be paid in accordance with these Terms & Conditions.
Reasonable supporting documentation, including photographs, invoices or repair quotations, will be made available upon request where appropriate.
13. Termination of Access
AÇAÍ Studios reserves the right to immediately terminate a booking, require individuals to leave the premises, revoke access, or refuse future bookings where the booking holder or any attendee:
Breaches these Terms & Conditions.
Causes or is reasonably believed to have caused damage to the studio, its fixtures, furnishings, equipment or neighbouring property.
Behaves in a threatening, abusive, violent, discriminatory, intimidating or otherwise unacceptable manner towards staff, neighbouring businesses or other visitors.
Endangers the safety of any person or creates an unacceptable health and safety or fire risk.
Is found to be smoking, vaping or using prohibited substances or prohibited items within the premises.
Is under the influence of illegal drugs or is intoxicated to the extent that their behaviour presents a risk to themselves, others or the premises.
Uses the premises for any unlawful purpose or criminal activity.
Exceeds the agreed maximum occupancy or permits unauthorised access to the premises.
Fails to comply with reasonable instructions issued by AÇAÍ Studios.
Fails to pay any outstanding booking fees, cleaning charges, damage costs or other monies due under these Terms & Conditions.
Where a booking is terminated due to a breach of these Terms & Conditions, no refund or compensation shall be payable. AÇAÍ Studios reserves the right to recover any additional losses, damages or costs arising directly from the breach, where permitted by law.
Any decision to refuse or revoke future bookings shall be made at the sole discretion of AÇAÍ Studios where it reasonably considers this necessary to protect the safety of individuals, the premises or the legitimate interests of the business.
14. Updates to This Agreement
AÇAÍ Studios reserves the right to amend or update these Terms & Conditions at any time to reflect changes in legislation, business operations, health and safety requirements or the services provided.
The most current version of these Terms & Conditions will always be made available via the AÇAÍ Studios website and/or booking platform.
Any changes will apply to bookings made after the revised Terms & Conditions have been published. Bookings confirmed prior to the publication of any updated Terms will remain subject to the version of the Terms & Conditions in force at the time the booking was made, unless otherwise agreed in writing.
Where changes are considered material and may affect existing customers, AÇAÍ Studios may notify regular clients or account holders by email or through its booking system.
